Closing your DSCR loan in an LLC

The short answer
- Asset protection is the #1 reason: close in your personal name and your personal assets are exposed if there’s ever litigation on the property.
- An LLC can keep your name off public records, depending on how you set it up. Full anonymity may take a holding company and a registered agent, and we can set that up for you.
- The loan may not show on your personal credit if you choose the right lender.
- An entity lets you add credit partners and capital partners and change ownership as you grow.
ASSET PROTECTION
The #1 reason not to close in your personal name
Close in your personal name and you open up your entire personal estate to liability if there’s ever litigation on that property. That alone is reason enough.
EVERYTHING ELSE
The other benefits of closing in an entity
- Anonymity. Set up right, nobody knows who owns the property. More on that below.
- Credit. The loan may not show up on your personal credit. Choose the right lender.
- Credit partners. You can put preferred credit partners in place for the loan.
- Flexibility. Change ownership percentages, take on capital partners, and add or remove people from the entity.
WHERE TO FORM IT
Domicile state vs. foreign registration
Your LLC’s domicile state is the state where it’s formed. If the property is in a different state, the LLC usually has to register there as a foreign entity before it can do business.
Buy a Florida rental with a Tennessee LLC and you’re maintaining two registrations: two sets of annual filings and fees, a registered agent in each state, and Tennessee’s franchise and excise tax on top. Forming in the state where the property sits keeps it to one state’s rules and one set of filings.
ANONYMITY
Keeping your name off public records
An LLC on its own doesn’t make you anonymous. Many states list members, managers or organizers on the public filing. Federal beneficial ownership (BOI) reporting no longer applies to U.S. companies, but state filings are still public record.
The fix is a holding company paired with a registered agent. The holding company owns your property LLC, and the registered agent’s address goes on the public filings, so your name doesn’t appear. We can set that up for you.
THE LENDER
Choose a lender that understands layered entities
Not every bank underwrites layered entities the same way. Submit your loan to a bank that doesn’t know how to read corporate resolutions or a holding company structure, and prepare for a rocky closing, if you get there at all. We match your structure to a lender that underwrites it correctly.
SETTING IT UP
Need a new LLC? We got you.
We have a dedicated team that sets up all our LLCs. The operating agreements are designed specific to your state and for real estate investing. Industry and state specific matters: a generic template isn’t written for a company that holds investment property, or for the lender that has to review it.

STRAIGHT ANSWERS
LLC questions
Can I get a DSCR loan in an LLC?
Yes. DSCR loans are built to close in an LLC or other entity.
Can I close a DSCR loan in my personal name?
Yes, but you give up asset protection, and you lose the anonymity and credit benefits an entity can give you.
Will a DSCR loan in an LLC show up on my personal credit?
It may not. Many business-purpose loans that close in an entity don’t report to your personal credit, but it depends on the lender, so choose the right one.
Do I need to form my LLC in the state where the property is?
Not always, but an LLC formed in another state usually has to register there as a foreign entity, which means two sets of filings and fees.
Will an LLC keep my name private?
Not on its own. A holding company paired with a registered agent keeps your name off public records, and we can set that up for you.
